    Avoiding Immunization Legally

    How To Legally Avoid Unwanted Immunization

    There are two fundamental rules you do not want to forget. These are:

    1. Nobody has the power or the right to immunize you or any of your family members against your conviction and your will. If they try to do this, you could charge them with “assault with a deadly weapon.”

    2. You can protect yourself with undesirable immunization because you have the American Law behind you. Those who wish to do otherwise are on shaky ground. It is stated in the immunization law that you could protect yourself from them. It is your obligation to use this.

    Always be diplomatic
    When communicating with members from the school, public health care providers or legal establishments, you always have to remain courteous and calm. If possible, you also have to revere to their position. You do not have to antagonize them.

    But if these officials are overstepping the law, then you have every right to bring this to their attention. You do not have to belittle them while attempting to do so. The more you preserve the ego of these people, the faster and easier you will obtain what you went there to obtain in the first place – an immunization waiver.

    There are no compulsory vaccination laws
    These so-called compulsory laws have waivers and exceptions. These were placed in order to legally exclude those who do not wish to be immunized. This was placed not for the protection of the individuals, but the protection of the whole establishment.

    To elaborate, let us say that the exceptions were not stated and everyone was asked to receive immunization. There is a likelihood that the child may die or become physically disabled or mentally ill. If so, then the parents can sue the doctors, the school, the health establishments and the state legislature for the damages.

    Because there are no exceptions, they must all accept the responsibility. That is the consequence. Therefore, the exception waivers are placed in order for the responsibility to go back to the parent. If let’s say the child was injured by the immunization, then those involved can easily say that the parent should have known better not to let the child obtain immunized.

    That is the very reason why there is no compulsory vaccination law in the United States.

    Know the law in your own state
    While all immunization laws come with exceptions, how each state words it can differ from the next. Therefore, you must know the law in your own state in order for you to make a request for waiver. This can be done in two ways.

    1. Go to your local library and ask for the State Statute Revised Law Book that can be found under Communicable Disease or Public Health Law. There is the list of the immunization requirements. One or two provisions may be listed. They may either be on medical grounds, religious or both.

    2. You can call or write to your state representative. Ask for copies of the immunization laws in the state. This is part of their job and they will promptly send you their request.

    Medical waivers
    There are two factors for exception – medical factors or religious reasons. Whichever one you select depends on how the state words the law. This should comply with your personal convictions.

    Medical exemption requires a note, certificate or waiver from the physician who has a license in the state. In some minute states, a physician’s authored statement is already accepted.

    The letter must explain the reason why there is a waiver for immunization exception. If possible, the length of time extended must also be indicated. There are laws that limit these letters to only a school year. Every waiver must be renewed during the fall season.

    Same rules apply
    The above-mentioned rule applies to schools. It is intriguing to note that there are also waivers in the Armed Forces. These branches provide immunization waivers as well.

    International Travel
    Regarding International Travel, the WHO or the World Health Organization based in Geneva grants American citizens the right to say no to shots whenever they travel internationally. However, if the area they wish to penetrate has an ongoing epidemic, the individual must be detained until the health servants give the go signal.
